The fines paid from 2004 to 2008, converted to Canadian dollars at rates of exchange in effect at the end of each year, are as follows:

• 2004 — In 2004 there were three penalties paid. A penalty of US $3,125 and payment in lieu of penalty of US$10,000, as a Supplemental Environmental Project for a VOC Emissions Reduction Project, for emissions monitoring downtime in January 2004 and emissions contraventions in April 2004. Two additional penalties totaling US$628 were paid for excess SO2 emissions.
• 2005 — In 2005 there were three penalties paid: US $323 and US $19,105 for excess SO2 emissions and US $12,000 for the falsification of data by a contractor in 2004 and 2005. This indicator only covers fines paid in 2005; other fines may have been served earlier.
• 2006 — In 2006 there were five penalties paid. Two penalties of US $8,85 and US $24,500 were paid for excess SO2 emissions and US$6000 for reporting of incorrect emission analyzer data in 2003 and 2005. A fine of US $18,000 resulted from an agency air regulatory inspection of Plant 2. As a result of payment requirements in the Valero Consent Decree (accrued with the purchase of Plant 2), a payment of US $500,000 in lieu of a penalty was made. This indicator only covers fines paid in 2006; other fines may have been served earlier.
• 2007 — In 2007 there were five penalties paid. A fine of US $255,000 was paid for various air-regulatory violations that occurred primarily in 2005. A fine of US $80,000 was paid for LDAR contractor data falsification that occurred in 2004. A fine of US $1,500 was paid for PCB leakage in 2007 and US $30,000 was paid for a high vapour pressure gasoline in 2006. Two fines, totaling US $109,100 were paid pursuant to the Consent Decrees negotiated by Conoco and Valero when their assets were purchased in 2003 and 2005, respectively. This indicator only covers fines paid in 2007; other fines may have been served earlier.
• 2008 — In 2008 there were four penalties paid. A fine of US $100,000 was paid pursuant to the Consent Decree negotiated by Valero with the Valero purchase in 2005. Two fines of US $53,000 and US$43,000 were paid for various air regulation violations that occurred in 2006. A fine of US $2,700 was paid for a flaring event that occurred in 2006.

This includes purchases of goods and services for the refinery in the pipeline group and for the clean fuels projects which make up the majority of the goods and services purchased at R&M.
